 “Scott Pruitt has supported efforts to make it easier for illegal Immigrants in Oklahoma to take advantage of taxpayer-funded benefits and make it more difficult for law enforcement officials to crack down on illegal immigrants,” Leonard said. “When given the opportunity to crack down on illegal immigration, Scott Pruitt has failed.

“In 2003, when Pruitt was in the State Senate, he championed and voted for Senate Bill 596 which provided in-state tuition to illegal immigrants. The bill ultimately afforded illegal immigrants the same status and rights as legal Oklahoma residents and cost taxpayers dollars.”

Leonard said the bill Pruitt supported led a conservative Republican senator to ask some of his fellow legislators a basic question: “My question to conservatives in favor of this bill is, What part of illegal do you not understand?”

In 2007, shortly after Pruitt left the State Senate, the State Legislature repealed Senate Bill 596.

“Senate Bill 596 wasn’t the only time Pruitt wanted to help Illegal immigrants,” Leonard said. “In 2001, the Tulsa World reported that as a candidate for Congress, Pruitt opposed increasing the powers of law enforcement officials to curb illegal immigration. According to the report, Pruitt ‘specifically opposed expanding the powers of any agencies responsible for enforcing immigration laws.’”

Leonard said he supports a strong federal policy cracking down on illegal immigration and has consistently been on record supporting state efforts to stop illegal immigrants from enjoying taxpayer-funded benefits.

October 27, 2004: Task Force Begins Work on Helping Hispanic Students Go to College

A task force designed to monitor implementation of a new state law that allows certain children of illegal immigrants to pay in-state college tuition is ready to go to work.

Members of the newly formed Advancement of Hispanic Students in Higher Education Task Force met for the first time recently to discuss the group’s role as spelled out in House Bill 2145, the legislation that created the task force.

Under the bill, the task force will monitor the implementation and administration of Senate Bill 596 that was passed during the 2003 legislative session.

SB 596 directed the Oklahoma State Regents for Higher Education to adopt policies that would allow undocumented students to enroll in Oklahoma’s public colleges or universities and also pay in-state tuition.

The task force will also study, report and make recommendations on issues involving student recruitment and retention of and completion by Hispanic students in Oklahoma higher education.

Senate Bill 596 passed and created Oklahoma Title 70, Section 3242:

Excerpt:

§70-3242.  Eligibility for enrollment and resident tuition - Immigrant status - Scholarships and financial aid.

A.  The Oklahoma State Regents for Higher Education shall adopt a policy which allows a student to enroll in an institution within The Oklahoma State System of Higher Education and allows a student to be eligible for resident tuition if the student:

1.  Graduated from a public or private high school in this state or successfully completed the General Educational Development test in this state; and

2.  Resided in this state with a parent or guardian for at least two (2) years prior to:

a.     graduation from high school, or

b.    successful completion of the General Educational Development test.

B.  To be eligible for the provisions of subsection A of this section, an eligible student shall:

1.  Satisfy admission standards as determined by the Oklahoma State Regents for Higher Education for the appropriate type of institution and have secured admission to, and enrolled in, an institution within The Oklahoma State System of Higher Education; and

2.  If the student is without lawful immigration status:

a.     file an affidavit with the institution stating that the student has filed an application or has a petition pending with the Bureau of Citizenship and Immigration Services to legalize the student's immigration status, or

b.    file an affidavit with the institution stating that the student will file an application to legalize his or her immigration status at the earliest opportunity the student is eligible to do so.  High school counselors shall inform immigrant students that they should apply for legal status as soon as possible to enhance their opportunity for higher education in Oklahoma.

C.  Any student who meets the criteria prescribed in subsections A and B of this section shall not be disqualified on the basis of the student's immigration status from any scholarships or financial aid provided by this state.
